This issue came up last year, but I guess it's just now going to court.  
They'll never get away with it.

But if they do manage to get away with it, I wouldn't be surprised if 
Microsoft or the W3C or somebody invents something new to make hyperlinks 
obsolete.

Yea, they'll see it.  They'll see it as a lame excuse for you to reach into 
their wallets.  They'll vote it down based on that.  There will be a press 
release saying that they honestly couldn't see the relation between then and 
now.  And that may be true.  But it won't matter.  In their hearts, they 
will think one thing:  BT stands for Brittish Tea party.

The hyperlink is dead!
Long live the hyperlink!
