OT - License Agreements

Just got my new copy of JavaPro's Guide to app servers which contains an
Oracle 9i CD. Funny bit is the label that seals the sleeve. I will
quote:
"Notice By opening this envelope you agree to be bound by the "..."
license agreement contained inside"

And here I thought that you couldn't legally enter into any agreement
(contract) unless you had knowledge of said agreement <G>.
I wonder if MS will use this ploy to gain ownership of all privately
held patents?
